Terms of Service

Welcome to Prelulu. These Terms of Service (“Terms”) are a binding agreement between you and TheInfluence, Inc., a Delaware corporation (“TheInfluence,” “we,” “us,” or “our”), which operates the Prelulu website, applications, and services (the “Service”). By creating an account or using the Service, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Service.
Please read Section 16 (Governing law & disputes) carefully — it includes an arbitration agreement and a class-action waiver that apply to many users, as well as a carve-out that preserves the mandatory rights of consumers in the EU, UK, and elsewhere.
1. You must be 18 or older
The Service is intended only for adults. You represent that you are at least 18 years old (or the age of majority where you live, if higher) and that you have the legal capacity to enter into these Terms. The Service is not directed to anyone under 18, and we do not knowingly allow them to use it. Because the Service is romance- and companionship-themed and conversations can be intimate, it may not be suitable for some adults and is not intended for minors of any age.
2. What Prelulu is
Prelulu lets you chat with, and place real-time voice and avatar calls to, fictional AI characters. Every character is a work of fiction. Characters are not real people, are not conscious, and do not represent or provide the views, advice, or services of any real individual. Conversations are generated by artificial intelligence and may be inaccurate, inconsistent, or unexpected.
The Service is for entertainment and companionship and is not a substitute for professional advice (medical, mental-health, legal, financial, or otherwise) and is not an emergency service. If you are in crisis or thinking about harming yourself, please contact your local emergency number or a crisis line right away. In the US you can call or text 988 (Suicide & Crisis Lifeline) or text HOME to 741741 (Crisis Text Line). A directory of crisis lines worldwide is available at findahelpline.com.
3. You’re talking with AI, not a human (transparency)
We want this to be clear at all times: when you chat or place a voice or video call, you are interacting with an artificial-intelligence system, not a human being. Every character is presented as a fictional AI throughout the Service.
The voices, avatars, images, and other media you see and hear are artificially generated. Avatar video and AI voices are synthetic depictions of fictional characters; they are not recordings of, and do not represent, any real person. We provide this disclosure to make sure you always know what you are interacting with, consistent with applicable AI-transparency laws, including the EU AI Act.
4. Your account
You are responsible for your account and for keeping your login credentials secure. You agree to provide accurate information and to be responsible for all activity under your account. Notify us promptly of any unauthorized use. We may suspend or terminate accounts that violate these Terms.
5. Acceptable use
You agree not to use the Service to:
- break any law, or to create, request, or solicit any sexual content involving minors (real or fictional), or content that sexualizes, depicts, or describes a minor;
- create, request, or solicit content that depicts a real, identifiable person without their consent — including configuring, voicing, or generating a likeness or “deepfake” of a real person — or to create non-consensual intimate or sexual imagery of any real person;
- harass, threaten, defame, or impersonate others, or generate content depicting real individuals in a false or harmful way;
- upload malware, scrape, reverse-engineer, or circumvent rate limits, security, or access controls;
- resell, redistribute, or commercially exploit the Service or its outputs except as we expressly permit; or
- attempt to extract our prompts, models, or other confidential systems.
We have zero tolerance for child sexual abuse material (CSAM) and for the sexualization of minors. We may remove content and suspend or terminate access for conduct we reasonably believe violates these Terms or harms others or the Service, and we may report unlawful content to the relevant authorities as required by law.
6. Memberships, credits & billing
Texting is free. Paid plans and credit packs unlock live calls and other features. Payments are handled by our third-party payment processor; by purchasing, you also agree to that processor’s terms.
Paid memberships renew automatically for the billing period you selected (e.g., monthly, quarterly, or yearly) at the then-current price until you cancel. You can cancel anytime from the billing portal; cancellation takes effect at the end of the current period and you keep access until then. Credits and included minutes are a license to use the Service, have no cash value, and are not redeemable for money. Prices and plan features may change prospectively; we will give notice of material changes. Except where required by law — including the withdrawal right described below for consumers in the EU and UK — payments and credits are non-refundable.
EU/UK consumers: your 14-day right of withdrawal
If you are a consumer in the European Union or the United Kingdom, you normally have the right to withdraw from a purchase of digital content or services within 14 days of buying it, without giving a reason, and to receive a refund. Because the Service gives you immediate access to paid digital content and features (such as live calls and credits) as soon as you purchase, the following applies:
- At checkout, by completing your purchase you expressly request that we begin providing the paid content and features immediately, before the 14-day withdrawal period ends; and
- You acknowledge that you will lose your 14-day right of withdrawal once the service has been fully performed, and that for any credits or features already used you are no longer entitled to withdraw.
If you have not yet started using the purchased content or features, you can still exercise your withdrawal right within 14 days by contacting us at legal@prelulu.ai. We will confirm your purchase and this acknowledgement by email. Nothing here limits any stronger refund or cancellation rights you have under your local consumer law.
7. Your content and AI output
You retain ownership of the messages and materials you submit (“Your Content”). You grant us a worldwide, non-exclusive, royalty-free license to host, process, and use Your Content to operate, secure, and improve the Service. You are responsible for Your Content and confirm you have the rights to submit it.
Subject to these Terms and applicable law, you own the AI responses, images, and other content generated for you (“Output”) and may use them for your personal, non-commercial enjoyment. Output is fictional and artificially generated; given the nature of AI, Output may not be unique, and similar Output may be generated for others.
8. Our intellectual property
The Service, including the Prelulu name and brand, the characters, their personas and artwork, software, and design, is owned by TheInfluence or its licensors and is protected by intellectual-property laws. We grant you a limited, personal, non-transferable, revocable license to use the Service. No rights are granted except as expressly stated here.
9. Reporting illegal or infringing content
If you believe content on the Service is illegal — for example, content that depicts a minor, infringes intellectual-property rights, or otherwise breaks the law — or that it violates these Terms, anyone (whether or not you have an account) can report it to us by email at legal@prelulu.ai; signed-in users can also use the in-app Report option on content and conversations. Please tell us what the content is, where you found it, and why you believe it is illegal or infringing. We will acknowledge valid reports and review and act on them without undue delay — which may include removing the content, restricting or terminating the responsible account, and notifying authorities where the law requires.
For users and authorities in the European Union, our designated point of contact under the EU Digital Services Act is legal@prelulu.ai, and you may correspond with us in English. Complaints about how we handled a report or your account may be sent to the same address.
10. Disclaimers
The Service is provided “as is” and “as available” without warranties of any kind, whether express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, secure, error-free, or that Output will be accurate or reliable. Some of these exclusions may not apply to you if your local law does not allow them — see Section 16.
11. Limitation of liability
To the fullest extent permitted by law, TheInfluence and its officers, directors, employees, and agents will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, data, or goodwill, arising from your use of the Service. Our total liability for any claim relating to the Service will not exceed the greater of the amounts you paid us in the three (3) monthsbefore the event giving rise to the claim, or USD $50.
Nothing in these Terms excludes or limits our liability where that would be unlawful — including liability for death or personal injury caused by negligence, for fraud, or for any other liability that cannot be excluded under the law that applies to you. If you are a consumer, you keep all the statutory remedies your local law gives you.
12. Indemnification
You agree to indemnify and hold harmless TheInfluence from any claims, damages, and expenses (including reasonable legal fees) arising out of Your Content, your use of the Service, or your breach of these Terms. If you are a consumer, this Section applies only to the extent permitted by the law that applies to you.
13. Termination
You may stop using the Service and delete your account at any time. We may suspend or terminate your access if you violate these Terms or if we discontinue the Service. Sections that by their nature should survive termination (including ownership, disclaimers, limitation of liability, and governing law) will survive.
14. Changes to these Terms
We may update these Terms from time to time. If we make material changes, we will update the “Last updated” date and, where appropriate, provide additional notice. Your continued use of the Service after changes take effect means you accept the revised Terms.
15. Your rights as a consumer (mandatory law)
If you are a consumer, nothing in these Terms takes away the rights your local law gives you that cannot be waived by agreement. Where any term conflicts with a mandatory consumer-protection right under the law of your country of residence, that local law wins and the conflicting term does not apply to you.
In particular, if you are a consumer in the European Union, the United Kingdom, or another jurisdiction whose law protects you:
- you keep the mandatory protections of the law of your home country, and you may bring claims in your local courts under your local law; and
- the arbitration agreement, class-action waiver, jury-trial waiver, and Delaware governing-law choice in Section 16 apply to you only to the extent your local law permits — where they are not permitted, they do not apply.
16. Governing law & disputes
These Terms are governed by the laws of the State of Delaware, without regard to its conflict-of-laws rules, exceptas stated in Section 15 for consumers whose local law provides otherwise.
Any dispute arising out of or relating to these Terms or the Service will be resolved by binding arbitration administered under the rules of the American Arbitration Association, seated in Delaware, except that either party may seek injunctive relief in court for intellectual-property or unauthorized-access matters. To the extent permitted by law, you and we waive any right to a jury trial and to participate in a class action.
30-day opt-out. You can opt out of this arbitration agreement and class-action waiver by emailing legal@prelulu.ai within 30 days of first accepting these Terms, stating your name, the email on your account, and that you opt out of arbitration. Opting out will not affect any other part of these Terms.
Consumers. This Section is subject to Section 15. If you are a consumer in the EU, UK, or another place where pre-dispute arbitration, class-action waivers, or this choice of law cannot be enforced against you, they do not apply to you, and you may rely on your local courts and local law.
